Mochi Paint (the “App”) is provided by CyberPrep Solutions LLC, a Texas limited liability company (“CyberPrep Solutions,” “we,” “us,” or “our”). By purchasing, installing, or using the App you agree to these Terms. If you are under the age of majority where you live, a parent or legal guardian must make the purchase and accept these Terms on your behalf — and by allowing a child to use the App, that parent or guardian accepts these Terms for the child. If you do not agree, do not install or use the App.
Mochi Paint is a coloring app: pick a character, color it, save or print it. It works offline, has no ads, no accounts, no chat or social features, and collects no personal data (see the Privacy Policy).
The App is sold through Google Play at the localized price Google Play displays when you confirm the purchase. There are no additional in-app purchases and no subscriptions. Your purchase is tied to your Google account and can be reinstalled on your devices under Google Play's rules. Refunds for the purchase are handled through Google Play's refund process and applicable consumer law; nothing in these Terms limits refund or withdrawal rights that your local law grants and that cannot be waived.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for personal, non-commercial use. We and our licensors own the App and its content — the Mochi Paint name, characters, artwork, coloring-page designs, and software — and reserve all rights not expressly granted.
Colorings you or your child create belong to you; we claim no rights in them and never receive them. All artwork and progress are stored only on your device. There is no cloud backup and no way for us to recover artwork: clearing the App's storage, uninstalling, or losing the device permanently deletes coloring progress, and artwork does not transfer between devices. Use the Save button to export finished pictures as PNG files if you want to keep them.
You agree not to copy, resell, or redistribute the App or its artwork; reverse engineer or modify the App except where law permits this; use the App to violate any law; or interfere with the App's parental-gateway mechanism. Coloring pages you export are for personal, non-commercial use.
The App asks an arithmetic question before opening external links or email. It is friction to keep children inside the App — not an age-verification or parental-consent mechanism — and you agree not to help a child bypass it.
The App is distributed and sold by Google Play under Google's own terms. We are not responsible for those services, and nothing here limits rights you have against Google under Google Play's terms.
We may update the App or its content and may eventually discontinue it. Because the App works offline once installed, an installed copy keeps functioning without our servers, but we do not promise uninterrupted availability of updates or the hosted version. Where a discontinuation triggers remedies under Google Play policy or applicable law, those remain available.
To the maximum extent permitted by law, the App is provided “as is” and “as available,” with all faults and without warranty of any kind, whether express, implied, or statutory. CyberPrep Solutions disclaims every warranty not expressly written in these Terms and does not promise that the App will be uninterrupted, error-free, or free of defects. You assume the entire risk of installing and using the App. If applicable law does not permit a particular disclaimer, that disclaimer applies to the greatest extent the law allows, and every other disclaimer in this section remains in full force.
You use the App entirely at your own risk. To the maximum extent permitted by law, CyberPrep Solutions LLC and its owners, members, officers, employees, and contractors are not liable for any loss or damage of any kind arising out of or relating to the App or these Terms — whether direct, indirect, incidental, special, consequential, punitive, or otherwise, and regardless of the theory of liability (contract, tort, negligence, strict liability, or any other) — including lost, corrupted, or unrecoverable artwork and data, which Section 5 explains lives only on your device. These limitations apply even if a remedy fails of its essential purpose and even if CyberPrep Solutions was advised of the possibility of the loss. By purchasing, installing, or using the App, you accept this allocation of risk and release, waive, and agree not to bring any claim, demand, or cause of action against CyberPrep Solutions arising out of or relating to the App. This allocation of risk is a fundamental basis of the bargain between you and CyberPrep Solutions, and the App would not be offered at its price without it. If, notwithstanding this section, any liability is imposed, it will be limited to the greatest extent applicable law permits and will not exceed the amount you paid for the App.
If your violation of these Terms or applicable law causes a third-party claim against CyberPrep Solutions, you agree to reimburse our reasonable resulting losses and costs to the extent permitted by the law of your jurisdiction. This does not apply to ordinary, intended use of the App.
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. The exclusive forum for any dispute arising out of or relating to the App or these Terms is the state or federal courts located in Travis County, Texas; you consent to their personal jurisdiction and waive any objection to that venue. You waive any right to a jury trial, and you agree to proceed only in your individual capacity — never as a plaintiff or class member in any class, collective, consolidated, or representative action. If any provision of these Terms is held unenforceable, it will be reformed and enforced to the maximum extent permitted, the remaining provisions will continue in full force, and no failure by CyberPrep Solutions to enforce a provision waives it. Sections 4–6 and 10–13 survive any termination of these Terms or your license.
We may revise these Terms by posting an updated version here with a new date; material changes will also be noted in the App's store listing. Continued use after the effective date is acceptance.
